Welcome to AskHEMI (Health & Medical Intelligence), your Personalised Health Intelligence companion powered by AI, developed by MedPlanner Sdn Bhd ("we", "our", or "us"). By downloading, accessing, or using the AskHEMI app (the "App"), you agree to these Terms of Use. Please read them carefully before using the App.

1. Acceptance of Terms
By using the App, you confirm that you are at least 16 years old (or the age of legal consent in your jurisdiction) and that you agree to comply with these Terms. If you do not agree, please do not use the App.

2. Nature of Service
AskHEMI is an AI-powered personal health companion designed to provide personalised health guidance, lifestyle support, and health information. The App uses optional health profile data you voluntarily provide to tailor its responses to your individual context.

AskHEMI does not replace professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before making decisions about your health.

3. Personalised Intelligence Feature
AskHEMI offers a Personalised Intelligence feature that allows you to optionally provide biometric, health, medical, and social data to improve the relevance and accuracy of the AI's responses. By using this feature, you understand and agree that:

  • Participation is entirely voluntary. You may use AskHEMI without providing any personal health data.

  • You may provide as little or as much information as you choose, and you may update or delete your health profile at any time.

  • The categories of data you may optionally provide include: biometric data (e.g. height, weight, blood pressure, blood glucose), medical history (e.g. diagnoses, medications, allergies, surgical history), lifestyle data (e.g. diet, activity levels, smoking, alcohol use), and social data (e.g. occupation, stress levels, living situation)

  • AI responses generated using your health profile are contextualised guidance only and do not constitute a clinical diagnosis, prescription, or treatment plan.

  • You are responsible for the accuracy of any data you submit. Inaccurate data may result in less relevant or potentially misleading guidance

  • Your health profile data is handled in strict accordance with our Privacy Policy, including your rights to access, correct, and delete your data

4. User Responsibilities
You agree to:

  • Provide accurate and truthful information when using the App, including any health profile data.

  • Use the App only for lawful purposes.

  • Not misuse the App for harmful, abusive, or fraudulent activities.

  • Maintain the confidentiality of your account and password.

  • Not submit health data belonging to another person without their explicit consent.

  • Seek professional medical advice for any health concerns, especially those involving symptoms, medications, or diagnosed conditions.

5. Intellectual Property

  • The App, including its content, design, AI models, Personalised Intelligence engine, and branding, is owned by MedPlanner Sdn Bhd and protected by copyright, trademark, and other applicable laws.

  • You are granted a limited, non-exclusive, non-transferable licence to use the App for personal purposes.

  • You may not copy, modify, reverse engineer, or distribute any part of the App without our prior written consent.

6. Data & Privacy
Your use of the App, including all data collected through the Personalised Intelligence feature, is governed by our Privacy Policy. The Privacy Policy sets out in detail how we collect, use, store, share, and protect your personal and health data. By using the App and enabling Personalised Intelligence, you consent to our data practices as described therein.

7. Disclaimers

  • The App is provided "as is" and "as available", without warranties of any kind, express or implied.

  • We do not guarantee that the App will be uninterrupted, error-free, or secure at all times.

  • AI-generated responses, including personalised responses based on your health profile, are for guidance only and may not always be accurate, complete, or applicable to your circumstances.

  • Personalised responses are based solely on the information you have provided to us and do not constitute a comprehensive medical assessment.

8. Limitation of Liability
To the fullest extent permitted by law:

  • We shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the App, including reliance on personalised health guidance.

  • We are not responsible for any health decisions you make based on the App's content, personalised or otherwise. Always seek professional advice.

9. Termination
We reserve the right to suspend or terminate your access to the App at any time if you violate these Terms, misuse the App, or submit false or harmful information that could endanger yourself or others

 

10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of:

  • Malaysia (PDPA 2010) for users in Malaysia

  • Indonesia (PDP Law 2022) for users in Indonesia

  • United Kingdom (UK GDPR & DPA 2018) for users in the UK

Where local law grants you additional rights, those will apply.

 

11. Changes to Terms
We may update these Terms from time to time, including to reflect changes to the Personalised Intelligence feature or applicable law. Continued use of the App after changes constitutes acceptance of the updated Terms. Material changes will be notified through the App or by email
